The High Court of Justice of Galicia (TSXG) has upheld the convictions of two men for the rape of a young woman in an apartment on Travesía de Vigo, as well as for the non-consensual recording of the assault. The events occurred in September 2022, when the victim met the defendants at a nightclub in the Arenal area of Vigo. After the bars closed, they all went to an apartment that belonged to a friend of one of the accused.
Inside the apartment, one of the defendants engaged in sexual relations with the young woman. According to the trial, the initial encounter was consensual, but later the second defendant entered the room, and both engaged in sexual acts with the victim, who repeatedly expressed that she did not want to continue. Additionally, a third person recorded the scene on his mobile phone without the victim’s consent.
The first defendant was sentenced to eight years in prison for a sexual assault offense, with the mitigating circumstance of having provided compensation for damages. The second was sentenced to eleven and a half years in prison: eight years for sexual assault and an additional three and a half years for the crime of unlawful discovery and disclosure of secrets, due to having recorded the sexual act without permission. He was also fined €2,520 for this second offense.
Both defendants must jointly compensate the victim with the amount of €17,000, of which €7,500 had already been deposited by one of the convicted men before the verdict as part of the damage compensation. Meanwhile, the third individual was acquitted of the charge of failure to render assistance.
